By creating a WeInspect account or using the service, you accept these terms. If you do not accept, do not use the service.

Plain language: WeInspect gives you a workshop, not a liability delegation. You remain the pro who signs the report. We give you breathing room (14-day trial, pro-rata refund, non-expiring credits) because a work tool should be reliable, not a trap.
1. Definitions
- "WeInspect" / "We" / "Our": the service offered by [LEGAL ENTITY], [legal form], NEQ [NEQ], with its head office at [HEAD OFFICE ADDRESS], Québec, Canada
- "You" / "User" / "Inspector": the person or entity using the service as a building inspector
- "Service": the WeInspect web and mobile application, including all its AI features
- "User Content": anything you upload, dictate, photograph, or write in WeInspect
- "Buyer": the person who receives an inspection report via WeInspect's client portal
- "Plan": paid or free subscription (Pay-as-you-go, Solo Unlimited, Solo Annual, Team, Student)
2. Acceptance and capacity
You declare:
- You are at least 18 years old
- You are a certified building inspector or in training, or you are authorized to represent an inspection business
- You have the legal capacity to accept these terms
- The information you provide is accurate and up to date
If you use WeInspect on behalf of a business, you declare you have authority to bind that entity.
3. User account
3.1 Creation
You create your account with a valid email and a strong password (12+ characters, verified against HaveIBeenPwned public breach databases).
3.2 Security
You are responsible for:
- The confidentiality of your password
- All activity carried out from your account
- Notifying us immediately at support@ouiinspect.ca of any unauthorized use
3.3 Multi-factor authentication (MFA)
MFA is available and strongly recommended for professional accounts.
4. Service offered
WeInspect is residential inspection software designed to facilitate:
- Field capture (photos, audio, GPS, annotations) — including offline mode
- Drafting inspection reports compliant with the BNQ 3009-500 standard
- AI-assisted finding generation (see section 7)
- Sharing reports with buyers via secure client portal
- Administrative management (clients, invoices, communications)
4.1 Availability
- Paid plans: target SLA availability 99.9% monthly basis (calculation excludes scheduled maintenance announced 48h in advance)
- Beta period: target SLA 99.5% (until public launch 2026-11-04)
- In case of degradation lasting >24 continuous hours, pro-rata credit automatically applied to next invoice
4.2 Offline mode
Offline mode lets you continue capturing content even without network. Synchronization resumes automatically when connectivity returns. Known iPhone limitation: background synchronization while the app is closed is not guaranteed due to Apple operating system restrictions. Your data remains safely stored locally and will sync the next time the app is opened.
5. Plans, payment and billing
Plain language: Solo Unlimited $89/month, 14-day trial with no credit card. If you're not happy after trying, you have a pro-rata refund guaranteed within 60 days. Your AI credits never expire. You can change plan or cancel any time. GST + QST added explicitly (5% + 9.975%), no hidden fees.
5.1 Public plans

Prices are in Canadian dollars, taxes extra (GST 5% + QST 9.975% added explicitly to the invoice).
5.2 Free trial
- Solo Unlimited: 14-day trial, no credit card required. No automatic renewal until you provide a payment method.
- Pay-as-you-go: first 3 inspections free, no commitment.
5.3 Automatic renewal
Paid plans automatically renew at the end of each period. You can cancel any time from /settings/billing. Cancellation takes effect at the end of the current period (no partial refund except section 5.4).
5.4 Pro-rata refund guaranteed
You may request a pro-rata refund for the unused portion of an annual subscription at any time, without justification, within 60 days following last use. Request to support@ouiinspect.ca. Refund processing time: 14 business days.
5.5 Plan change
You can change plan at any time:
- Upgrade: immediate effect, pro-rata billed
- Downgrade: effect at end of current period
- Unused AI credits: kept without expiration as long as your account is active (Québec Consumer Protection Act)
5.6 Payment failure
In case of payment failure (expired card, insufficient funds), we retry on days 3, 7, and 14. Beyond that, access switches to read-only mode. On day 15, the subscription is canceled and the account downgraded to Pay-as-you-go.
5.7 Tax-compliant receipts (Québec Consumer Protection Act)
Each invoice includes: WeInspect's GST and QST numbers, date, pre-tax amount, GST, QST, total, your name and address, service description, sequential number.
6. User content
Plain language: your inspections, photos, audio, reports — they're yours, period. We claim zero ownership over your work. We just need a license to store and serve it back to you, and — if you ask — to pass it through AI. We never use it to train Claude or any other third-party model. Final validation of the report remains your professional responsibility (BNQ, Civil Code, AIBQ/AICQ/AAPI).
6.1 Ownership
You retain full ownership of user content. WeInspect claims no ownership over your inspections, photos, audio, or reports.
6.2 License granted to WeInspect
You grant us a non-exclusive, worldwide, royalty-free license, limited to:
- Hosting, storing, transmitting your content to provide you the service
- Processing it via AI according to your explicit consent (section 7)
- Sharing it with buyers you designate (client portal)
- Using it, in anonymized and aggregated form, to improve the product (analytics)
We never use your content to train third-party AI models (see section 7.3).
6.3 Responsibility for content and professional obligations
You are solely responsible for:
- The factual accuracy of observations in your reports
- Your professional inspector liability (BNQ 3009-500, Québec Civil Code art. 1457, 1726-1739)
- Respecting third-party rights (privacy of occupants, owners, etc.)
- The consent obtained from occupants to photograph the interior of a private property
6.4 Recognition of professional codes of conduct
WeInspect is a tool, not a certification authority. If you are a member of a professional association of building inspectors in Québec, your association-specific ethical obligations always prevail over software features. You acknowledge in particular, without limitation:
- AIBQ — Association des inspecteurs en bâtiment du Québec: code of ethics, client confidentiality obligations, file retention requirements, residential inspection practice standards
- AICQ — Association des inspecteurs et experts en bâtiment du Canada (QC chapter): code of ethics, quality assurance program
- AAPI — Association des architectes paysagistes / other specialized associations as applicable
- InterNACHI Québec or other applicable grouping
If a WeInspect feature (e.g., automatic report sharing, extended retention, AI suggestion) conflicts with an obligation of your association, your obligation prevails. Disable the feature concerned or adjust its configuration. WeInspect provides you with the necessary granular controls (sharing settings, retention durations, AI disabling) precisely so you can comply with your professional code without contortion.

6.4 Prohibited content
You may not upload content that:
- Is defamatory, hateful, harassing
- Infringes copyright, trademark, or other third-party IP
- Contains malware or malicious code
- Depicts a minor in a compromising situation
- Violates applicable laws
We reserve the right to suspend or delete your account without prior notice for serious breach.
7. AI features — specific clauses
Plain language: AI makes suggestions. You sign the report. If the AI hallucinates a BNQ reference and you publish without checking, your civil and professional liability answers — not ours. It's hard but it's coherent: a tool cannot carry your license for you. In return, we are transparent on how AI works (page AI Clauses →) and we give you a "disable everything" button that actually works.
7.1 Nature of AI features
WeInspect uses AI models for:
- Audio transcription (OpenAI Whisper)
- Finding generation from your captures (Anthropic Claude Sonnet 4.6)
- Automatic photo classification (Claude Sonnet 4.6 vision)
- Targeted text rewriting
- BNQ + Civil Code assistance chatbot (if enabled)

7.2 Suggestions, not decisions
AI produces suggestions. Final validation is the inspector's responsibility, who is professionally accountable for content published in their report. You may refuse, modify, or ignore any suggestion. WeInspect never substitutes for your professional judgment or your BNQ 3009-500 obligations.
7.3 No training on your data
Anthropic and OpenAI contractually commit not to use your data to train their models. This clause is explicit in our contracts with these providers.
7.4 AI liability limitation
To the extent permitted by law:
- We do not warrant the factual or regulatory accuracy of AI suggestions
- We are not liable for errors or omissions in your reports resulting from unverified use of AI suggestions
- The inspector retains full civil and professional liability for reports they sign and publish
7.5 AI credits
- Each AI action consumes a number of credits indicated in
/settings/credits - Credits included in your plan do not expire as long as your account is active
- Additional credits purchased à la carte do not expire
- The credit ledger is consultable at any time
7.6 Disabling AI features
You can disable all AI features from /settings/privacy/ai. WeInspect remains fully usable without AI (capture, manual drafting, report, client portal).
8. Client portal (buyer)
8.1 Mechanism
You can share an inspection report with a buyer by generating a secure link /client/[token]. The buyer does not need to create a WeInspect account.
8.2 Obligations toward the buyer
- You are responsible for ensuring the buyer's consent to receive their data via WeInspect
- You are responsible for revoking access if necessary
- The buyer can contact us directly at dpo@ouiinspect.ca to exercise their Law 25 rights

9. Multi-seat (Team plan)
9.1 Seats
The Team plan allows additional seats. Each seat = one authenticated user. Seats can be reassigned among team members.
9.2 Roles
- Team admin: manages seats + billing + shared resources
- Inspector: normal use + access to shared resources
9.3 AI credit pool
Team AI credits are pooled. Per-user consumption is tracked in the ledger.
9.4 Shared data
Inspections, templates, and findings can be shared according to rules configured by the team admin. Row-Level Security separation guarantees no data leaks outside the team.
10. WeInspect intellectual property
10.1 Trademarks and logos
"WeInspect", the logo, and visual identity are trademarks of [LEGAL ENTITY]. You may not use them without written permission.
10.2 Software
The code, interface, textual and graphic content of WeInspect are protected by copyright. You only obtain a usage right in accordance with your plan.
10.3 BNQ findings library
Our pre-written findings library is licensed under Creative Commons BY-SA 4.0 (attribution + share-alike) — free use in your reports, modifications allowed, sharing encouraged.
11. Liability limitations
Plain language: if we cause you damage, our maximum liability is capped at what you paid us in the last 12 months. But: the QC Consumer Protection Act remains applicable and we do not exclude cases of gross fault, privacy breach, or violations that are non-excludable by law. It's not a trap, it's the SaaS standard — we just wrote in plain terms what's protected for you regardless.
11.1 Service as is
The service is provided "as is" and "as available". Subject to mandatory provisions of the Québec Consumer Protection Act, we exclude all implied warranties (merchantability, fitness for a particular purpose).
11.2 Cap
To the extent permitted by law, our total liability to you for any loss is limited to the amount of fees paid by you to WeInspect during the 12 months preceding the event.
11.3 Exclusions
We are not liable for:
- Indirect, consequential damages, loss of profit, loss of reputation
- Errors in your reports resulting from unverified use of AI
- Acts or omissions of buyers accessing your reports
- Failures of third-party providers (Stripe, Anthropic, OpenAI, Supabase, Netlify, Resend) beyond contractual SLA
11.4 Non-excludable cases
Nothing in this section limits our liability for: gross or intentional fault, unrectified privacy breach, fundamental rights violation, or any other case where the law prohibits limitation.
12. Indemnification
You agree to indemnify WeInspect against any third-party claim resulting from:
- Your use of the service in violation of these terms
- Your user content infringing third-party rights
- Your professional negligence in drafting reports
13. Suspension and termination
13.1 By you
You may terminate at any time from /settings/billing. See 5.3-5.4 for handling of current period and pro-rata refund.
13.2 By us
We may suspend or terminate your account:
- In case of serious breach of terms (7-day notice except emergency)
- In case of non-payment (procedure section 5.6)
- In case of detected abusive use (rate-limiting, malicious behavior)
- If required by law
13.3 Consequences
On termination:
- Service access cut immediately
- You have 30 days to export your data (then automatic deletion except legal retention obligations)
- No refund is owed in case of termination for serious breach on your part
13.4 WeInspect end of service (Act 25 art. 22)
If WeInspect permanently ceases operating the platform — voluntary closure, bankruptcy, or transfer to a third party you reject — here are our contractual commitments:
- Minimum 30-day notice before effective shutdown (email + in-app banner + Trust Center announcement). CAI notification if transfer to a third party.
- Free 60-day export window starting from the announcement:
- Self-service export /profile/privacy/export maintained for the entire window - ZIP format with signed manifest documented at /transparency/data-export-schema - Manual email support available for technical issues (reply < 7 business days)
- Pro-rata refund of the last payment if shutdown happens during a subscription cycle, per the pro-rata refund guarantee (5.4)
- Guaranteed data destruction after the export window (production + backups + sub-processors), with a public attestation signed by the DPO published at
/transparency/closure. Legal exceptions (tax invoices 7 years, audit logs pseudonymized 7 years) explicitly listed in the attestation. - Third-party acquisition case: you will be informed before the transfer with right to object (Act 25 art. 30). If you object, you recover your data and your account is deleted before the assignment. If you don't respond within 30 days, the transfer proceeds with the buyer continuing to honor the Privacy Policy and these Terms.
- No obligation of service continuity beyond the 60-day export window. However, Privacy Policy §13bis ("If WeInspect ceases operations") commitments (destruction + DPO attestation) and Act 25 art. 22 remain applicable.
This section is complementary to Privacy Policy §13bis ("If WeInspect ceases operations") which details the personal information protection side.
14. Changes to terms
We may modify these terms. In case of substantial change:
- 30 days notice by email + in-app notification
- For changes unfavorable to the consumer, new explicit acceptance required

15. Governing law, jurisdiction, and arbitration
15.1 Governing law
These terms are governed by the laws of Québec and applicable federal laws of Canada.
15.2 Jurisdiction
Any dispute will be submitted to the competent courts of the judicial district of [JUDICIAL DISTRICT], Québec. Class actions provided for by law remain available.
15.3 Pre-litigation mediation
Before any legal action, the parties commit to attempting good-faith amicable resolution for 30 days.
16. Miscellaneous
- Assignment: you may not assign your rights without our written consent. We may assign our rights in connection with a merger, acquisition, or reorganization, with 30 days' notice.
- Severability: if a clause is invalid, the others remain in effect.
- No tacit waiver: not exercising a right does not constitute waiver.
- Force majeure: no party is liable for breach caused by a force majeure event.
- Language: the French version prevails. The English version is provided for convenience.
